Right to Work Check Amendments
The Government has announced that temporary covid-adjustments to ‘right to work checks’ will now be extended to 31 August 2021. In-person ‘right to work checks’ will now be reinstated from 1st September 2021 instead. This is a result of the Government’s announcement to extend the date for the easing of lockdown restrictions and social distancing measures.

Please note that these checks are applicable to all new starters including casual and student workers as well as those renewing their visa. Furthermore, from 01 July, legislation will change the way employers carry out right to work checks for EEA citizens. The updated guidance is available at GOV.UK. Please note, where checks are carried out before 1 July 2021, EEA citizens may continue to evidence their right to work using their EEA passport or national identity card.
It is vital that new starters do not commence work prior to a ‘right to work’ check taking place. This is very likely to be where the Home Office concentrate audit checks and penalties in the coming months.
